BattlEye for a singleplayer game? Can anyone verify it?

I don't see any files which would suggest this is the case. Any other way to check it?

Ran a search for *BattlEye*, BEService.exe and BEService_x64.exe, nothing found anywhere in the game's folder or on my system drive. I think it's safe to say that the game doesn't use it.

Avatar is exhibiting some strange behavior for me and I haven't been able to figure out why. At Ultra settings DLSS quality I will get between 90-117(lg c2 120hz) but then performance will tank down to 60 fps and sometimes under. Changing DLSS and settings doesnt seem to help much and even ULTRA to LOW seems to have no major effect in fact VRAM usage still sits above 15.5 GB even at Low which doesnt make sense to me.
